§ 1
Agreeing to these terms
These terms are an agreement between you and The Ark Technology Services Pty Ltd (ABN 49 647 336 687), the Australian company that makes Boker (“we”, “us”). They apply to the Boker apps, the service they connect to, and this website. By creating an account or using Boker, you agree to them and to our privacy policy.
You must be at least 13, and old enough to agree to these terms where you live. If you are under 18, a parent or guardian should read them with you.
§ 2
Your account
- Give us an email address you can receive mail at, and keep your password and devices secure.
- An account is for one person. Don’t share it or use someone else’s.
- You are responsible for what happens in your account. Tell us straight away at support@getboker.app if you think someone else has used it.
§ 3
The free month and subscriptions
Free month. A new account gets 30 days of full access from the day it is created, with no payment details needed. The free month is given once per person: a new account made with the same email address or Apple or Google account continues from the original end date.
Subscriptions. After the free month, adding and changing things in Boker needs a subscription, bought in the app through the App Store or Google Play. The plans and prices are shown in the app before you buy, in your local currency.
- Payment is charged to your Apple or Google account when you confirm the purchase.
- Your subscription renews automatically at the end of each period, at the then-current price, unless you cancel at least 24 hours before the period ends.
- Manage or cancel it in your App Store or Google Play subscription settings. Deleting the app or your Boker account does not cancel it.
- Apple and Google handle billing and refunds under their own policies. Ask them for a refund, through their usual process.
- If we change a price, Apple or Google will tell you before it applies, as their rules require.
§ 4
If your subscription ends
Your account becomes read-only. You can still sign in, see everything you made, and export it. You can’t add or change things until you subscribe again. We don’t delete your data because a subscription ended.
§ 5
Your content
What you put in Boker is yours. You give us permission to store, copy, process and display it only as needed to run Boker for you: to keep it on our servers, sync it to your devices, and, if AI capture is on, send the lines you type to our AI provider as our privacy policy describes. This permission ends when you delete the content or your account, apart from the backup periods in the privacy policy.
You are responsible for your content and must have the right to put it in Boker. We keep regular backups to run the service, but they are not a personal archive. Use Settings → Export your data if you want your own copy.
§ 6
AI capture, reminders and notifications
AI capture suggests what a line is. Suggestions can be wrong, so check each draft before you confirm it. You can turn AI capture off at any time.
Reminders and notifications depend on your phone’s settings, battery and operating system, and may arrive late or not at all. Don’t rely on Boker alone for anything where a missed reminder could cause harm, such as taking medication or meeting a legal deadline.
Expense totals and budgets are for your own planning. They are not financial, tax or accounting advice.
§ 7
Using Boker fairly
Don’t:
- break the law, or use Boker to store or share unlawful content;
- try to get into other people’s accounts or data, or into parts of the service you aren’t meant to reach;
- copy, modify or reverse engineer the apps, except where the law allows it;
- get around the free month, subscriptions or usage limits, or use bots or scripts to call the service;
- overload, disrupt or probe the service for weaknesses (if you find one, please tell us at support@getboker.app).
§ 8
Our app and brand
We own the Boker apps, service, name, logo and design, or license them from others. We give you a personal, non-exclusive, non-transferable licence to use the apps on devices you own or control while you follow these terms. Fraunces, the typeface on this site, is used under the SIL Open Font License.
If you send us feedback or ideas, we may use them without owing you anything.
§ 9
Other companies’ services
Boker works with services run by others, such as Sign in with Apple, Google sign-in, the App Store and Google Play. Their own terms apply to your use of them, and we aren’t responsible for them.
§ 10
Changes to Boker
We keep improving Boker, so features will change, and some may be added or removed. We will try to keep the service available, but it may sometimes be interrupted for maintenance or problems outside our control. Because the apps keep your data on your device, you can usually keep using them while the service is down.
If we ever decide to shut Boker down, we will give you at least 60 days’ notice and a way to export your data. Where the law requires, we will refund any period of subscription you have paid for but can’t use.
§ 11
Closing your account
You can delete your account at any time in Settings → Account → Delete account, or by following the steps on our account deletion page. What happens to your data is set out in the privacy policy.
We may suspend or close an account that seriously or repeatedly breaks these terms, or where the law requires us to. Unless the law or security stops us, we will tell you why first and give you a chance to fix the problem and to export your data.
§ 12
Your rights under consumer law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law, or under any other law that can’t be excluded, including the consumer laws of the country you live in.
§ 13
Limits on our liability
Subject to section 12, and to the extent the law allows:
- Boker is provided as it is and as available, and we don’t promise it will be error-free or always available;
- we are not liable for indirect or consequential loss, or for loss of profits, revenue or data that we couldn’t reasonably have foreseen;
- our total liability to you for any claim about Boker is limited to the amount you paid for Boker in the 12 months before the claim arose.
Where the Australian Consumer Law lets us limit our liability for failing to meet a consumer guarantee, our liability is limited to supplying the service again or paying the cost of having it supplied again.
§ 14
App Store and Google Play
If you got Boker from Apple’s App Store:
- These terms are between you and us, not Apple. We, not Apple, are responsible for Boker and its content.
- Your licence lets you use Boker on Apple-branded devices you own or control, as allowed by the Usage Rules in Apple’s Media Services Terms and Conditions.
- Apple has no obligation to provide maintenance or support for Boker.
- If Boker fails to meet any applicable warranty, you may tell Apple, and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for Boker. Any other claims, losses or costs caused by a failure to meet a warranty are our responsibility, subject to these terms.
- We, not Apple, are responsible for handling any claims about Boker, including product liability claims, claims that Boker fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If anyone claims that Boker or your use of it infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling and discharging the claim.
- You confirm that you are not in a country subject to a US Government embargo or designated by the US Government as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, may enforce them against you.
If you got Boker from Google Play, Google Play’s terms of service also apply to your download and purchases, and Google is not responsible for Boker.
§ 15
Governing law
These terms are governed by the laws of New South Wales, Australia, and the courts there can hear any dispute about them. If you live in another country, you keep any protections its laws give you that can’t be excluded, and you can bring a claim in your local courts where those laws allow. Before going to court, please email us so we can try to sort it out.
If any part of these terms can’t be enforced, the rest still applies.
§ 16
Changes to these terms
We may update these terms, and will change the date at the top when we do. If a change matters, we will tell you in the app or by email at least 30 days before it takes effect, and may ask you to agree to it again. If you don’t agree, you can stop using Boker and delete your account.
